10-Year-Old Boy Cannot Stand Trial As Adult

GREENVILLE, Ohio -- The prosecutor in Darke County said a 10-year-old boy, who was charged with killing five people by setting a house on fire last week, cannot be certified as an adult to stand trial.Ohio law does not allow a child under the age of 14 to be tried as an adult. He was charged with one count of aggravated arson and five counts of murder.However, Darke County Prosecutor Richard Howell said a judge could label the boy as a serious youth offender, which means he could serve time in the Ohio Department of Youth Services until age 21.At that time, a judge would review his case. If it is found that the boy did not follow the rules under the Department of Youth Services, he could then be sent to serve additonal time in an adult prison.
