Ex-Assistant Band Director Still Waiting Release From Jail

TROY, Ohio -- Once electronic monitoring equipment is installed, former Milton-Union High School band director Anthony Spahr, 28, of Troy, is expected to be released from the Miami County jail on his own recognizance to his mother's home in Troy.Spahr has been in the county jail for a month since being arrested on a charge of sexual battery. A second charge of sexual battery has been been filed against him. A Miami County Sheriff's deputy accused Spahr of having sexual contact with two underage female students at Milton-Union.During a motion for reconsideration of bond Monday morning, Judge Jeffrey Welbaum agreed to release Spahr, despite the objections voiced by Miami County Prosecutor Gary Nasal, who felt that Spahr still was a risk to society.Welbaum ordered that Spahr be banned from the village of West Milton during the pendency of the case. Other restrictions include that he be at least a mile from the homes, the places of employment and the schools of the victims and their families. Spahr must also avoid being around other minors.Asked by the judge if he understood, Spahr said, "Absolutely."Spahr has been in jail since Nov. 27.Steve.Baker@WHIOTV.com
