Possible Expert Witness Questioned In China Arnold Case

DAYTON, Ohio -- New information was released Friday afternoon about a Dayton mother accused of killing her baby in a microwave oven.Court testimony in a pre-trial hearing reveals that China Arnold may have been drinking 150 proof Rum the night her 1-month-old baby died.Arnold walked into court shaking hands with her defense attorney ready to listen to a man that her attorney hopes will qualify as an expert witness for her trial.The first question was about what his report concluded about what Arnold drank the night her baby died. He said about 40 percent of a pint of 151 Rum.However, prosecutors said Arnold said something different.Arnold’s baby, Paris Talley, died in August of 2005. After a 14-month investigation, police concluded that Talley died due to burns inflicted by being put in a microwave and having it turned on.Arnold was arrested in November 2006. Police reports indicated that Arnold admitted to drinking with the baby’s father the night the child died, but police said she was the only adult home when the baby got burned.Her defense attorney claims that her blood alcohol level could have been as high as four times the legal limit and she would have passed out or ibeen ncapable of putting a child into a microwave.Dr. Belloto said, “I think the literature supports me. It would be extremely hard to perform that task.”However, prosecutors think Belloto relied too much on Arnold’s own statements about how much she drank and whether she was passed out or semiconscious.Belloto is the second of three possible expert witnesses that could testify at the trial. One more will be questioned next Tuesday and then the judge will decide if any of the three can testify during the trial, which is scheduled to begin two weeks from next Monday.Arnold has pleaded not guilty to aggravated murder. If convicted, she could be facing the death penalty.
