Dayton Gang Member Incorrectly Released Turns Himself In

Federal authorities said that suspected Dayton Diamond Cut gang member, Levy K. Smith was recently transferred to the Corrections Reception Center after receiving a 180 day sentence.

Authorities said upon his arrival at the prison, a jail term computation was conducted and it was learned that Smith’s pre-sentence jail time exceeded his sentence.

According to Deputy U.S. Marshal Bill Taylor, because the federal detainer, which had been lodged against Smith in August 2007 was also not transferred to the prison records section, he was released from custody and is now considered a fugitive.

Smith was charged and pleaded guilty in federal court to conspiracy to distribute and possession with intent to distribute cocaine and possession of a firearm by a convicted felon.

Federal officials said Smith is a member of the Diamond Cut Street Gang and should be considered armed and dangerous.

Deputy U.S. Marshal Bill Taylor said Smith Turned himself in at the Montgomery County Jail Monday Evening.
