Victim’s Identity Released In Officer-Involved Shooting

Dayton police have released the name of the man who was shot by an officer on Thursday night.

According to Chief Richard Biehl, Derrick J. Jordan, 22, is in critical condition at Miami Valley Hospital.

Investigators said that they were conducting undercover drug investigation in the 2100 block of Edwin C. Moses Boulevard around 8 p.m. when the shooting happened.

According to Biehl, detectives were attempting to arrest the occupants of a car in the parking area of a McDonald's restaurant when the driver accelerated and struck Detective David House with his vehicle. Biehl said the driver then swerved and sideswiped Detective Raymond St. Clair who was positioned near the vehicle.

Police said St. Clair's firearm accidentally discharged on impact with the car, entering the rear passenger window on the driver's side, and House then fired one shot at the driver though the front passenger side window after "perceiving an imminent risk of harm to Detective St. Clair and responding officers."

Police said House's bullet is believed to have struck Jordan, who was sitting in the front passenger seat of the vehicle.

Officers said the driver of the car continued to flee through the parking lot with detectives on foot and vehicles in pursuit. They said one of the occupants tossed a handgun out of the passenger side window, and the suspect's car was then rammed by an officer driving an unmarked police vehicle.

Police said two occupants attempted to run, but all were apprehended.

The driver of the car, Charles D. Stargell Jr., 24, was arrested and charged with two counts of felony assault on a police officer.

A passenger, Robert A. Moore, 19, was arrested and charged with felony drug trafficking.

A fourth occupant was released without criminal charges being filed, and police said Jordan is not facing any charges at the present time.

Both officers were treated and released from the hospital, but according to the president of Dayton's Fraternal Order of Police, Randy Beane, both officers could need surgery.

According to a search of police reports by News Center 7, the area where Thursday's incident happened is a frequent area for drug arrests. Prior to this incident, reports show that there have been 18 arrests so far in 2008, all involving either heroin or crack cocaine. Police have seized hypodermic needles, syringes, crack pipes, money and cell phones during those arrests.

Both officers are on administrative leave pending an outcome of the police investigation. Biehl said that once the investigation is complete, the case will be reviewed by the Montgomery County Prosecutor's Office, and an internal affairs investigation will be concluded thereafter.

This is the second officer-involved shooting in Dayton in the past two weeks.
