Prosecutor Wants Teen Accused Of Arson Tried As Adult

Montgomery County Prosecutor Mat Heck has filed a motion to transfer16-year-old Joshua Goings to adult court.

Goings is charged in connection with two arson cases in Jefferson Township. The first fire occurred on July 10 in a garage.

Goings is also accused of committing aggravated arson, burglary, and retaliation on Aug. 21 at a home on Albers Avenue in Jefferson Township.

Goings is the son of Earl McLearran who is currently under indictment on two counts of ethnic intimidation against the residents of the Albers Avenue home.

If prosecuted in Juvenile Court, the maximum possible sentence that Goings could get would be a commitment to the Department of Youth Services until the age of 21.

Goings is 16, so this would amount to the maximum commitment of less than five years. Under Ohio law, upon reaching the age of 21, Goings would then be released.

Heck said, “ This juvenile retaliated against the victims of crimes committed by his father. Victims of crime should be free to report crimes committed against them without the fear of being retaliated against and victimized again.”
