Man Shot By Police Under Influence Of Drugs

Toxicology reports show a local man had five drugs in his system when he was shot and killed by a Dayton Police officer last May.

Cocaine, codeine and heroin were among the drugs detected in the blood of Larry Labensky, 44, of Kettering. Cocaine was also found in his pocket.

Labensky was shot five times on May 6th, by Officer Christopher Cornwell. The shooting happened behind a home on Saylor St.

Officers and sheriff's deputies were following Labensky on suspicion that he was connected to two robberies.

It was later determined that he was not the man police wanted.

A Montgomery County Grand Jury decided last week not to hand down any criminal charges against Officer Cornwell. He returned to his job on the police force in June.
