Dayton Attorney Accused Of Grand Theft

DAYTON, Ohio -- A Dayton attorney has been indicted on six charges accusing him of stealing money from multiple clients.A Montgomery County grand jury indicted Charles Bursey II in four separate theft cases.According to the Ohio Supreme Court, Bursey was suspended from practicing law in September 2008 after several complaints began coming in to the Dayton Bar Association.On Aug. 18, the bar association filed a relator's motion for immediate interim remedial suspension. According to the document, Bursey engaged "....in a course of conduct involving a blatant disregard for his obligations to his clients, as well as conversion, fraud and deceit."One victim named in one of the indictments said he hired Bursey to represent him as the plaintiff in a personal injury case. The man, who wished to remain anonymous, said he never received any of the money reached in the settlement."I was supposed to get $2,900, but never got it. Never got a penny," he said. "You hire someone to do some work and they are supposed to be truthful, that's the oath you take."Bar association documents say Bursey deposited the man's money into his personal bank account.Bursey is charged with three counts of theft beyond scope, one count of theft by deception and two counts of grand theft.According to the bar association documents and officials with the Montgomery County Prosecutor's Office, the grand theft allegations stem from Bursey's role as a guardian in the estate of a minor. The complaint alleges Bursey left a balance of $10.92 in the account, which started at $10,476.33.Bursey was arrested on theft charges, but was released on bond.News Center 7 made several attempts to contact him Monday but was unsuccessful.Bursey's stepmother, Ruth Bursey, said the family is supporting him despite the allegations."We support him and love him and we are sorry for what is happening," she said. "This will work itself out because we still have faith and love him."Bursey's father, Charles Bursey, said his son had a gambling problem. Ruth Bursey agreed."That's an addiction just like alcoholism is," she said.Authorities with the Dayton Police Department and prosecutor's office could not confirm if gambling played a role in their investigations.Bursey will be in court for an arraignment Tuesday morning.
