Trotwood Man Sentenced For Fatal Shooting

A Trotwood man who gunned down a college student in the parking lot of a gas station earlier this year, was sentenced for his crime.

Kyle McClendon, 23, faced a judge Thursday in Montgomery County Common Pleas Court.

Prosecutors said the violence began when the victim, 20-year-old David Driscoll bumped into McClendon inside the gas station. Words were exchanged and witnesses thought the incident was over.

In the courtroom before the sentencing, McClendon heard from Driscoll's family members. Gretchen Driscoll said, " I cry myself to sleep. David died alone without a hug from someone who loved him."

McClendon also heard a very direct speech from Judge Dennis Langer. Langer said, "As we see on the tape, you shot him five times deliberately with intent to kill him."

The tape that Judge Langer referred to is the surveillance tape that caught the two outside the gas station. The tape showed McClendon waiting for Driscoll to come outside and then he opened fire.

Gretchen Driscoll said, "I demand that he be given life so he can no longer lift a weapon and kill another living human being."

Judge Langer sentenced McClendon to 15 years to life in prison and 8 years for felonious assault. That is in addition to prison time for several weapons charges, for a total of 26 years to life behind bars.

In addition to the prison time, McClendon was also ordered to pay restitution for funeral expenses that totaled more than $4,200.
