Law Enforcement Cleared In Shelby Co. Chase

Posted: 4:40 pm EST November 19, 2009

Law enforcement agencies in Shelby County have been cleared of any wrong doing in getting a semi rig to stop by shooting at its radiator.

The incident stems from a pursuit in September that went through two counties.

The chase involving the semi came to an abrupt end when a deputy fired a shot into it radiator. The truck rolled to a stop and the driver, 43-year-old Alan Branscum was taken into custody and arrested.

Branscum was wanted on a charge of attempted murder in connection with trying to strike his wife several times with a hatchet.

Gary Nasal, Miami County Prosecutor made sure that the call for deadly force was proper and justified.

On Sept. 18. Shelby County Sheriff Dean Kimpel gave the order to use deadly force if Branscum would not stop, but the last shotgun blast halted the truck.

A week ago, Branscum entered pleas of not guilty to two counts of felonious assault and for failure to comply with an order of a police officer.
