Attorneys For Jim Barton Seek Evidence Withdrawal

Friday, August 13, 2004 – updated: 8:38 am EDT August 13, 2004

Attorneys for a former Springboro police officer charged in connection with his wife's murder appeared in court on Thursday, hoping to have some new evidence thrown out.

Prosecutors said Jim Barton, 48, paid two men to stage a break-in at his Franklin Township home in 1995. His wife Vickie was killed during the burglary.

Barton's attorneys are trying to get a 911 call and details about fingerprints found at the scene thrown out because of contradictory claims about them.

The judge is expected to decide in 30 days if the evidence will be allowed in the case.
