Opening Statements Made In Barton Murder Trial

POSTED: 11:53 am EST February 8, 2005

A former police lieutenant went on trial Tuesday morning in connection with the murder of his wife. Jim Barton was accused of plotting a burglary that prosecutors said ended with Barton's wife, Vickie, being killed and raped.

Vickie Barton was killed in 1995 inside the Bartons' home in Franklin Township.

On Tuesday morning, the jury heard from the prosecutor in the case and from Jim Barton's attorney. During opening statements, both sides told the jury what they believed happened the day Vickie Barton was killed.

Prosecutors said Jim Barton wanted to move from his home to Springboro because he wanted to become the police chief there. According to prosecutors, Barton set up a burglary at his home, in order to scare his wife.

Prosecutors point to a 911 call from Barton after he found his wife dead. They said during the call, Barton mentions Will Phelps, along with another man, who prosecutors believe killed Vickie Barton.

The defense said Barton did not say Will Phelps on the 911 call, but said he talked about getting help. Barton's attorney also said his client had a good marriage.
