An alleged Oxford rapist was not indicted for that crime by a Butler County grand jury.

Francisco Naupa Rivera, 23, of Fairfield, was accused of entering five off-campus student houses at Miami University in September. One student accused him of rape, but the grand jury tendered a “no bill” on that charge and aggravated burglary. Rivera was indicted on burglary, two criminal trespass charges and trespass in a habitation charge.

Oxford police say Rivera entered a home on East Spring Street on Sept. 14 and touched a sleeping female on her arm, according to Sgt. Jon Varley. Rivera allegedly told the woman he was looking for a male friend and quickly left the house. No men live in the house.

The woman gave a description of Rivera’s car to police, who located it about a block away at a home on East Collins Street. Police found the front door of the home open and a side door ajar. Once they entered the residence, they found Rivera and a woman who reported he raped her.

Varley said Rivera first told police he was looking for a female friend and then said he was searching for a male friend. No one in the house knew him.

Rivera is in the Butler County Jail, the place where he wed 20-year-old Kaleigh Ohmer on Feb. 25. He is being held on a $100,000 bond and is scheduled for arraignment before Judge Craig Hedric on Nov. 28.

Khaalid Walls, a spokesman for U.S. Immigration and Customs Enforcement, said if Rivera is found guilty on the current charges he could be deported to his native Peru.
