Charges Against Former Dayton Legislative Aide Dropped

DAYTON, Ohio —

A former legislative aide for Dayton city commissioners is no longer facing charges of sexual battery.

A Montgomery County grand jury indicted Larry Miller Jr. in March 2008 on four sexual battery charges. He was accused of engaging in "sexual conduct with another....when the offender knew that such other person submitted because she was unaware that the act was being committed."

Now, more than a year later, Miller's attorney says there was no evidence to support those charges and the charges were dropped.

However, Miller did plead guilty to a lesser charge of sexual imposition, a misdemeanor, that does not carry a jail sentence.

"We were delighted with the result," said defense attorney John Rion. "The reduced charge was a mere touching of a person that was impaired."

Rion said Miller and the woman had a previous relationship when the incident happened.

Miller, who served as an aide to Dayton city commissioners, was ultimately fired after news of the sexual battery case was uncovered by News Center 7.

Investigative reporters found that city leaders did not do a background check on Miller, who had a criminal history that included serving more than a decade in prison for the attempted murder of a Central State police officer.

At the time, police representatives were stunned to learn that they were working closely with a man convicted of shooting an officer.

In 2008, Dayton Fraternal Order of Police President Randy Beane said, "You have a guy that shot a police officer, who, for all intensive purposes, wanted to kill him. What type of message is that sending? The city of Dayton: Shoot a police officer, come here and we'll put you on a pedestal?"

The city terminated Miller in April 2008, citing his criminal and driving record.

Miller will be sentenced for his sexual imposition plea in July. Rion said Miller will be put on probation and labeled a Tier 1 sex offender, which means he will be required to register his address once a year for the next 15 years.
