China Arnold Will Get Third Trial

DAYTON, Ohio —

A Dayton mother, convicted of killing her infant daughter by placing her in a microwave, will get a new trial.

The Court of Appeals of Ohio cleared the way for that trial on Thursday afternoon, by denying a prosecution request to reconsider their earlier ruling.

Arnold's mother Gloria Scott said, "I'm so glad to know the wheels of justice are turning. We're elated like we've always been."

Arnold was accused of killing her her 1-month-old daughter, Paris Talley, in 2005. Prosecutors said she was badly burned in a microwave.

Her first trial ended in a mistrial. She was convicted in a second trial and sentenced to life in prison without parole. Earlier this fall, the appeals court overturned that conviction.

Montgomery County prosecutors asked the appeals court to not grant a third trial, but the court denied the state's motion, saying prosecutors wrongfully withheld witness information from Arnold's defense team.
