MONTGOMERY COUNTY —
A Dayton corrections officer caught on camera stealing from inmates has been found guilty.
Officials with the Montgomery County Prosecutor’s Office said a motion was made to sever two counts of theft against Malcom Capps, 37. One was heard Monday in a bench trial, where the guilty verdict was handed down.
A scheduling conference will occur at 1:30 p.m. Dec. 17 for the other count.
No sentence will be determined until both counts are presented in court. Capps, a corrections officer with the Montgomery County Sheriff’s Office, was originally indicted on four felony counts of theft in office accusing him of stealing from inmates being processed into the county jail.
Sheriff’s Maj. Daryl Wilson said jail sergeants reviewing surveillance video spotted something that raised concern and discovered that Capps was seen taking cash from inmates on several occasions. Corrections officers are responsible for logging individuals’ personal possessions as they are processed into the jail.
The indictment lists incident dates of Feb. 28 and March 4.
Capps, of Union, worked at the jail for nine-and-a-half years.
Capps faces up to a year in prison on each fifth-degree felony count.
