A man accused of raping a 3-year-old girl was released from jail after one day, but police say they are still pursuing charges against him.

Kendall Lynch Jr., 19, was arrested and booked into the Montgomery County Jail on Thursday.

On Friday afternoon, when it became apparent that medical test results on the alleged victim were not going to be available in less than 48-hours, he was released.

Lynch remains a suspect in the rape investigation, according to Dayton police, who intend to pursue prosecution once test results are returned.

His mother told News Center 7 last week that he is innocent.

“Nothing has happened. The child was never left alone when she was here,” said Monique Jones. She initially declined to talk about the incident and tried to grab and hit News Center 7’s camera.

Dayton Police Sgt. Larry Tolpin said the sexual assault happened on Feb. 24 while the victim was in the care of Jones’ daughter at a home on Harvard Boulevard. Lynch lives at the address in the 1300 block with his relatives.

Tolpin said at some point the victim was left alone with Lynch, who has no prior criminal arrests as an adult. Juvenile arrest records are sealed, so it is unknown if he has any criminal record prior to turning 18.

“My son has never ever been in trouble,” Jones said.

She and her son Antonio Jones both said that the girl was playing in the basement of the home with Lynch’s 10-year-old half brother and that she was never unattended.

Jones said the girl’s mother is a friend and the news of the allegations came as a total shock to her.

“Her mother was a friend of mine. She had lived in my home before, and her daughter,” Jones said. “If that’s the case then why all of a sudden now you’re saying that something like this has happened?”

Police took a report on the incident on March 5 after the girl told her mother of the alleged rape.

Tolpin said the victim has been evaluated by doctors and is in good condition.

Police do not believe there are any other victims at this point.
