Man arrested for possession of fake crack cocaine

DAYTON —

A man avoided a felony drug possession charge Thursday night by revealing to police that the drugs found in his car were in fact fake.

Tony Lavon Scott, 25, was charged instead with misdemeanor offenses involving counterfeit drugs. He is also charged with transporting an open container of liquor in his vehicle.

Possessing, making or selling any counterfeit controlled substance is illegal under the Ohio Revised Code.

Scott was pulled over on West Hillcrest Avenue because of excessive window tint on his car.

Police noted in an incident report that he smelled of marijuana, so a K9 unit was called to sniff the car for drugs.

Officers found a small amount of marijuana in the car and what appeared to be a bag of crack cocaine. They also found an open bottle of liquor under the driver’s seat.

While being placed under arrest, Scott asked if he could contest the arrest and said “That’s not crack, it’s fleece,” referring to fake drugs. According to the report, he said it was a mix of some pills and baking soda.

Police tested the substance and determined it was indeed not crack cocaine.

Scott was taken to the Montgomery County Jail, but had been released on bond as of Friday morning.
