Isotec Jury Returns Verdicts

MIAMISBURG, Ohio —

A jury on Friday returned verdicts on the compensatory damage claims of the first 31 plaintiffs whose cases went to trial resulting from the Sept. 21, 2003, explosion at Isotec in Miamisburg.

The jury awarded an average of $150 per person, plus evacuation expenses. The highest award was $625, but most were lowered. Several plaintiffs received awards of just $35.

The jury arrived at their decision after listening to a week and half of trial testimony.

Marty Foos, Isotec attorney, said, “We are pleased that the jury evaluated each plaintiff’s case separately and on its own merits.”

Immediately after the explosion, Isotec established a claims reimbursement process to reimburse its neighbors who had expenses or damage claims resulting from the explosion and evacuation.
