DPD investigating suspicious child deaths

DAYTON, Ohio —

Dayton police investigators are looking into two suspicious deaths reported on Friday involving children.

The first case was recorded around 1 p.m., and the victim was a 2-month-old boy. 

 Dustin Gard, 21, was arrested in connection with the death of his 2-month-old son. Police found the child unresponsive in 1600 block of Suman Avenue after a report of a child who was not breathing.

Gard was booked into the Montgomery County Jail on an initial charge of felony child endangering pending autopsy results, according to Dayton Police Lt. Wendy Stiver. 

Gard has twice been arrested before for domestic violence, according to Montgomery County Jail records.

In 2009, Gard was charged with disorderly conduct but allowed to plead guilty to a lesser charge of disorderly conduct. He was placed on two years probation, according to Montgomery County Municipal Court records.

In 2010, he was charged with domestic violence, but the charge was dismissed, according to Vandalia Municipal Court records.

The second case was reported around 4 p.m. Friday. The mother of a 4-year-old boy and a man not related to that child were arrested on felony charges of permitting child abuse after that child was pronounced dead at Children’s Medical Center of Dayton.

Police were dispatched to 19 Five Oaks Ave. after the boy had reportedly fallen down the stairs, according to Stiver.

“When the officers arrived, the extent of the child’s injuries were immediately apparent,” she said. “The child’s condition was extremely grave.

“The nature of the injuries were inconsistent with the statements made by the (911) caller and the witnesses,” she said. “That almost automatically triggers an investigation.”

A 2-year-old was also in the house.

Heaven Lenoir, 25, and Matthew D. Henderson, 29, were both arrested at the scene and booked into the county jail.

According to jail records, Henderson has been booked into the Montgomery County Jail on a series of misdemeanors.

The arrest on Friday marked his first felony arrest.

Jail records also indicate Lenoir’s arrest was her first for a felony. She had been arrested and charged in connection with a domestic violence case in 2009. The charge was ultimately dismissed.

“Both of (Friday’s deaths) are suspicious,” Stiver said. “Our special victims unit detectives are investigating both.

“Two infant deaths in one day taxes their resources and I can’t give a time line as far as when their investigations will be wrapped up,” she said.
