SPRINGFIELD —
An Enon man on Thursday afternoon pleaded guilty to one count of involuntary manslaughter in the death of a woman at an Enon transitional-care facility in November 2011.
Cody Sutton, through his attorney, accepted a plea agreement that allowed him to admit to a lesser charge. He had been facing one count of murder and two counts of arson in the death of Kathleen Hart, 89.
Clark County Common Pleas Judge Richard O’Neill set sentencing for Nov. 28.
Sutton remains in the county jail.
The sprinkler system at Dayspring of Miami Valley, 8001 Dayton-Springfield Road, helped contain a fire there on Nov. 25, 2011, to the laundry storage room, officials said.
Hart suffered a cardiac episode during the evacuation, police said. She died at Miami Valley Hospital.
Police said they had video of Sutton, an employee of the facility, in the rooms where the fire started moments before the fire erupted.
He was arrested June 21 after a secret indictment was returned by a county grand jury.
The facility was cleared of any safety issues, according to reports.
