The Butler County prosecutor’s office has determined a flier found in a Miami University residence hall is not constitutionally protected speech and charges may be filed against two male students.

A “Top Ten Ways to Prevent Rape” flier was removed Oct. 8 from McBride Hall, according to Matthew Dwyer, a resident advisor. Later that evening, Dwyer found a new sheet called “Top Ten Ways to Get Away with Rape” placed in the men’s restroom.

The flier “gave detailed steps on how to successfully rape a female,” according to police.

Misdemeanor or felony charges are possible depending on the outcome of the police investigation, Prosecutor Mike Gmoser said Tuesday.

“The incident is currently under investigation,” said Miami University Police Chief John McCandless. “We will present our findings to the Butler County Prosecutor’s office and they will determine what the appropriate charges will be.”

Miami University officials have said the school will discipline the two students responsible for posting the flier.

Miami’s Office of Ethics and Student Conflict Resolution can take action if a student is found to have violated Miami’s Student Code of Conduct. Potential code of conduct sections violated by the creation and posting of this flier and related damage in the corridor include mental abuse or harm; damage to property; and disorderly conduct.

Potential sanctions for a student found responsible for violating these sections include removal from the residence hall, mandatory educational programs and suspension.
