The Dayton SWAT team was called Monday night to Kings Highway after shots were fired.

DAYTON —

One man was arrested Monday night after police were called to a report of shots being fired on Kings Highway.

Police were called to 3754 Kings Highway where, according to a Dayton Police incident report, a man fired four or five shots at another individual who was riding his bike in the area and then fled into his apartment before police arrived.

The SWAT team was called in as a precaution but police were able to arrest the suspect without incident.

The victim told officers he was riding his bike near the King’s Court apartment complex when a guy dressed in sweats asked him what he was doing. The man then went inside and came back out with a gun. He fired four or five shots at the victim who was able to run away and call police.

He told officers when they arrived that he saw the guy peeking out of a window on the third floor of the apartment building. The building manager came out and confirmed that she saw the incident and the suspect was in his apartment upstairs.

Officers were able to get the suspect’s girlfriend outside safely, then ordered him out with his hand up.

According to the report, they searched the apartment and couldn’t find any guns. The suspect’s girlfriend admitted that she saw him stick the gun in her backpack and handed it to some neighbors before police arrived.

The neighbors admitted to having the backpack and later admitted they took the gun out and hid it under a sleeping back, where officers recovered it.

Those neighbors could face tampering with evidence charges.

The suspect was taken into custody pending felonious assault charges, but no charges had been filed as of Tuesday afternoon and the individual was not listed as a jail inmate.
