DAYTON —

Two men were taken to jail for fighting Saturday night in front of Roosters restaurant.

Dayton officers were dispatched at 7:25pm to Roosters, located at 3501 North Main street on a report of a fight in the lobby. The first arriving officer didn’t see any fight and went inside to check the lobby. When the officer spoke with an employee of Rooster’s, they told him the fight was taken outside.

The Officer exited the restaurant and located the restaurant security guard, who had walked around from the back of the building. The two fighting suspects also walked from the rear of the building and approached the area where the officer was standing.

As two other officers arrived, the two suspects took an aggressive stance and then lunged at each other punching with closed fists. Officers commanded them to stop but they refused. Fearing they would harm themselves, the officer drew his Taser and fired at one of the suspects, later identified as 31 year old Wayne Nalls. One Taser contact hit a part of Nalls clothing with the other contact hitting the body. There was no connection made from the contacts.

Another officer seeing this occur, drew his Taser and fired at Nalls, hitting him with both contacts making a intended connection. Nalls stopped, stood up straight for a couple of seconds and then and dropped to the ground. Officers cuffed Nalls and the other suspect, 32 year old Sylvester Ballard.

Both were booked into the Montgomery County Jail on Misdemeanour Disorderly Conduct.
