Staff Report

EATON, Preble County —

A 21-year-old man accused of raping a 17-month-old girl was abusive to the infant's mother and at least one of her other children before the alleged sexual assault, according to the incident report.

The Preble County Sheriff's Office arrested Joshua B. Cook on Wednesday after gathering evidence that he sexually and physically assaulted the daughter of his girlfriend, 22-year-old Casey Myers.

According to the incident report obtained Thursday, Myers went to work and left her 17-month-old and 5-year-old children in Cook's care at about 11 a.m. at the home they shared.

Four hours later, Jerry Myers, the victim's grandfather, went to the house with his girlfriend, Lori Kalies, to pick up Casey Myers' children. They did so after Cook made multiple threats to destroy the house while Casey Myers was at work.

According to her statement to investigators, Cook was upset that he did not have cigarettes, and she could not provide a receipt to him for an item not mentioned in the report. Cook called his girlfriend and her co-workers throughout the day to harass them, according to the incident report.

At about 3 p.m., the children were taken from the home and left in the case of Lori Kalies. Casey Myers left work and when she returned to her house to pick up some of her property, Cook and Jerry Myers began arguing.

Casey Myers told investigators that Cook grabbed her by the throat on June 29 and spanked one of the children earlier in the week. A sheriff's deputy responded to the house when the argument turned physical.

While the deputy was on scene, Kalies called Casey and Jerry Myers and told them the 17-month-old girl had a bloody diaper and cut on her genitals, according to the incident report. The girl was immediately taken to Dayton Children's Medical Center at the urging of the deputy.

At the hospital, a social worker informed deputies that the exam revealed signs of sexual abuse, a bruise on the girl's back and buttocks and two fractured bones in her right forearm.

Detectives contacted Cook on Wednesday, and he agreed to meet with investigators at the sheriff's office. Cook thought they wanted to speak about a separate issue and he declined to speak without a lawyer about the allegations of physical and sexual abuse.
Cook was arraigned Friday in Eaton Municipal Court and did not enter a plea. He is being held on $250,000 bond in the Preble County Jail on two counts of rape, two counts of second-degree felony child endangering, and single counts of sexual battery and third-degree felony child endangering.
