Medicaid Fraud Case Nets Ohio $15.6 Million

Companies Overcharged For Medication

COLUMBUS, Ohio —

Ohio Attorney General Marc Dann announced Friday a major settlement with two drug companies accused of overcharging the Medicaid program for drugs.

Dann said Bristol-Myers Squibb and its former subsidiary, Apothecon, have agreed to pay Ohio and other states a total of $403 million.

Ohio’s share of the settlement is $15.6 million.

In its lawsuit against the companies, Ohio accused them of charging inflated prices for drugs.

The lawsuit also alleged the companies provided payments to doctors and pharmacists to induce them to prescribe and dispense the companies’ products in violation of federal and state laws.

Dann said his Medicaid Fraud Control Unit led the negotiations in the case along with Fraud Control Units from New York, Massachusetts, Vermont and New Mexico.
