Organization Says Local Business Discriminated Against Disabled

BEAVERCREEK, Ohio —

On Wednesday the Miami Fair Housing Center filed a lawsuit against the The Greene, located in Beavercreek, and its developers alleging discrimination against people with disabilities.

In the lawsuit, the group alleged that the developer of the Greene failed to comply with federal accessibility standards in the design and construction of its properties.

In a statement, a spokesperson for The Greene said the company was surprised by the filing of a lawsuit on Wednesday. “Many, if not most, of the requested changes have already been implemented,” Michael Duffey, a spokesperson for The Greene’s developer, said. “If further changes are necessary, we will make them. It is worth noting that we have received no complaints from our actual residents.”

The Miami Valley Fair Housing Center helped initiate this lawsuit. Michael Allen, an attorney for the organization, said its members inspected apartments at The Greene and found the alleged violations.

The 22-page lawsuit alleged that apartments at Gilbert Court at The Greene had architectural barriers that would make it difficult for people who use a wheelchair to live there. In a news release the plaintiffs said those barriers included “steps to the bedrooms, narrow hall widths and bathrooms with insufficient clear floor space.”

“Steiner was founded over a decade after the passage of the Fair Housing Act, yet after all these years, people with disabilities continue to face discrimination because of Steiner’s inaccessible designs,” said Jim McCarthy, President and CEO of the Miami Valley Fair Housing Center. “We will not allow them and their partners to continue harming the community and denying housing to people with disabilities by designing and constructing inaccessible housing.” Steiner + Associates is the developer of The Greene.

The Metropolitan Milwaukee Fair Housing Council and the National Fair Housing Alliance are also plaintiffs in this lawsuit. In addition to suing The Greene and its developers, the lawsuit also names housing developments in Missouri and Wisconsin and several architectural and construction companies.

“We always try to go above and beyond to be accessible, friendly, safe and enjoyable,” Duffey said. “We are complying fully with the regulatory bodies whose job it is to review ADA and FHA compliance. We are more than happy to correct any oversight that was made during construction.”
