Prosecutors Release Statement In Dropped Charges

DAYTON, Ohio —

Prosecutors in Montgomery County have released a statement about their decision to release a 14-year-old boy. They accused him of taking part in the slaying of another 14-year-old boy who was riding his bike.

Authorities said his 16-year-old brother remains in custody.

Investigators said last week, Richard Richardson III was shot in the head while riding his bike on Hold Street.

Deondre Austin appeared in Juvenile Court last week handcuffed to his 16-year-old brother Anthony. The two were accused in the slaying of Richardson. Late Monday afternoon, prosecutors dismissed the case against Deondre.

On Tuesday, they released a statement.

"We met with Dayton detectives yesterday and took a more in-depth look at the evidence in this case. Based on what we have right now, we made the decision to dismiss the charges against the 14-year-old at this time. He was released from juvenile detention yesterday. The murder charges against his 16-year-old brother remain the same as originally charged."

Dayton police continue to investigate the homicide, but would not comment further on their investigation.

Prosecutors told NewsCenter 7 that there was no new revelation in the case or abrupt change in information or evidence in connection with the teen’s release. They said the dismissal of charges were based upon a deeper review of the evidence and statements made in the case.
