Cohen was originally put in jail following a high-speed chase Monday morning with police in Huber Heights. He was eventually captured and booked into the Montgomery County Jail on a misdemeanor charge.

Cohen told Huber Heights police that there was a warrant for his arrest, but they were not able to find one. Due to overcrowding in the jail, Cohen was released at 4:26 a.m. Monday morning.

Investigators said at 5 a.m. Monday, he went to his ex-girlfriend's house in Dayton and raped her. Sgt. Tom Flanders said Cohen entered the house with an old key he was not supposed to have while the woman was asleep and raped her.

Authorities said they later discovered that Cohen did have a warrant for not showing up earlier in the month for sentencing on a domestic violence charge. They said the victim in that case, was his his ex-girlfriend.

Dayton police are not happy about Cohen being mistakenly released. They said they are not sure why Huber Heights police did not know about the warrant. Officials in Huber Heights believe it may have been a computer glitch.

Police said that Cohen was supposed to turn himself in to police at 9 a.m. Thursday morning, but he didn't show up.

Authorities said Cohen's ex-girlfriend will recover physically, but mentally it could take some time.
